You are still under the 5 year power train warranty, so take it to the nearest VW dealership and if it is the ECU it will be fully covered (unless you had it tuned in which case they might refuse).

Depends, if he tracks his car often like it sounds that he does then the tune will affect long term reliability. Even on DSG. Your maintaince will be noticeably more expensive too over the long term.
